These Terms of Use ("Terms") are an agreement between you and NoBand ("we," "us") covering your use of the NoBand app for iPhone and Apple Watch, its widgets, and the NoBand coach service (together, the "App"). By downloading or using the App you agree to these Terms. If you don't agree, please don't use the App.
1. NoBand is not a medical device
The App provides general fitness and wellness information only. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.
- Scores such as Recovery, Strain, Sleep, Stress, Body-State patterns (e.g., "fighting something"), and Fitness Age are statistical estimates derived from consumer sensor data. They can be wrong, incomplete, or affected by sensor gaps.
- Never ignore professional medical advice or delay seeking it because of something the App showed you. If you feel unwell, experience symptoms, or the App shows unusual readings, consult a qualified healthcare provider.
- Training suggestions (strain targets, bedtimes, "do not train today") are informational. You alone are responsible for deciding whether, how, and how hard to exercise. Consult a physician before starting any exercise program, especially if you have a medical condition, are pregnant, or take medication that affects heart rate.
- If you think you may have a medical emergency, call your local emergency number immediately.
2. The AI coach
The coach chat feature uses a large language model. AI-generated responses:
- may be inaccurate, incomplete, or inappropriate for your situation despite our safeguards;
- are general wellness conversation, not medical, nutritional, or psychological advice;
- should be verified before you act on anything consequential.
The coach can *suggest* journal entries, but nothing is written to your journal without your explicit confirmation. The AI coach is currently included free of charge; heavy AI usage may become an optional paid add-on in the future — we will announce any such change in the app before it takes effect, and it will never remove features you already paid for.
3. Your data and Apple Health
The App reads data you authorize from Apple Health and processes it as described in our Privacy Policy, which forms part of these Terms. You are responsible for the accuracy of data you enter manually (profile, journal). Revoking Health permissions may limit or disable App functionality.
4. Free week and one-time purchase
- The App is free to use for 7 days from first launch. After that, continued use requires a one-time unlock purchase (price shown in the App and on the App Store).
- The unlock is a one-time, non-consumable purchase — not a subscription. It never renews and never charges again.
- Payment is processed by Apple. Purchases can be restored on any device signed into the same Apple Account via "Restore Purchases."
- Refunds are handled by Apple under App Store terms; we cannot issue refunds directly.
- Sign in with Apple is required only to complete a purchase; all other features work without an account.
5. External AI agent connections
If you choose to connect an external AI assistant using an agent token, you do so at your own risk. The token grants read access to your NoBand data snapshot; you are responsible for which agents and services you give it to. We may revoke tokens or suspend the agent-connection feature at any time for security reasons.
6. License and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the App Store terms. You agree not to:
- reverse-engineer, copy, resell, or redistribute the App or the coach service;
- abuse, overload, probe, or attempt to gain unauthorized access to the coach service or other users' data;
- use the App for any unlawful purpose.
7. Service availability
Online features (AI coach, diagnostics, agent connections) are provided on a best-effort basis and may be modified, interrupted, or discontinued at any time. Core scoring works offline and does not depend on our servers.
8. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCORES OR AI RESPONSES ARE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY PERSONAL INJURY OR HEALTH OUTCOME ARISING FROM RELIANCE ON THE APP, TO THE EXTENT SUCH LIMITATION IS PERMITTED IN YOUR JURISDICTION. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR IT. Nothing in these Terms limits liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.
10. Apple's role
These Terms are between you and NoBand, not Apple. Apple has no obligation to provide support or maintenance for the App and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's standard Licensed Application End User License Agreement applies to the extent not covered here.
11. Changes and termination
We may update these Terms; material changes will be announced in the App with an updated effective date. We may suspend or terminate access to online features if you violate these Terms. You can stop using the App at any time by deleting it.
